About the Longshore And Harbor Workers’ Compensation Act

The Longshore and Harbor Workers’ Compensation Act provides workers’ compensation benefits for maritime workers who are injured on navigable waters. These benefits include disability payments and rehabilitation services. Benefits are also available to the surviving families of maritime workers killed in work-related accidents.

Many different maritime workers are covered by the Act. These include longshoremen and harbor workers who are employed loading and unloading vessels, repairing vessels and building vessels. While the Act requires that the accident occur on “navigable waters,” the term also includes places near the water, like piers, wharves, dry docks and terminals.

The Importance Of Acting Quickly

If you are a longshoreman or harbor worker who has been injured on the job, it is critical that you act quickly. The law gives employees who have been injured on the job just 30 days to give their employers notice of their injuries. The law also requires that a formal Longshore and Harbor Workers’ Compensation Act claim for benefits must be filed with the Department of Labor within one year from the date of the injury.
