RULING ON WORKERS' COMP OPENS UP BENEFITS TO INJURED WORKERS IN PENNSYLVANIA

In an article posted by the Pittsburgh Post-Gazette www.post-gazette.com, thousands of injured workers statewide could receive more benefits after the Pennsylvania Supreme Court struck down a key part of the workers' compensation law.

NO MORE IMPAIRMENT RATING EVALUATIONS.

The court's decision eliminated the practice of using the American Medical Association guidelines to place a cap on benefits paid out to severely injured workers.

According to the guidelines, if a worker fell under a 50 percent threshold, insurance companies could reduce payments to reflect a partial injury and cap benefits at 500 weeks, or nearly 10 years.

Rhett P. Cherkin, a partner of Caroselli Beachler & Coleman said, very few physicians return a greater than 50 percent rating according to the AMA guidelines.
