Indoor swimming pool liability

Even though the weather is a bit on the chilly side for swimming in an outdoor pool, lake or river for most of the country right now, there are many indoor pools and waterparks that stay busy all year round. Many of the indoor pools are found at hotels and other types of lodging. There are laws that govern what is required by a business to have a swimming pool on their property.

In Pennsylvania, there are many laws and regulations that must be adhered to in order to operate a public or private swimming pool. Some of these laws deal with:

-- The height of the fence surrounding the pool.

-- The type of latching mechanism on the gate.

-- How often the water must be tested and what it must be tested for.

-- When and how many lifeguards are required.

-- Plumbing, electrical and other code requirements.

These are just a few of the topics that must be addressed at a public pool. Even when these requirements are met, there may still be questions of premises liability when someone is injured. Private pools have some laws, regulations and codes that are different.

At Caroselli, Beachler Et Al, we represent those who have been injured due to a property owner's negligence. A successful premises liability case must be able to prove that the property owner was responsible for the dangerous condition that led to the injury or he or she allowed that hazard to occur. The case must also prove that the property owner knew that the hazard was there or should have known it was there.

We want to hold those property owner's responsible for your injuries and losses. To learn more about premises liability cases, please review our webpages on the topic.
