Understanding wrongful death lawsuits

If a family member is killed in an accident, you could be entitled to compensation depending on the circumstances. A wrongful death lawsuit allows individuals who lose loved ones in fatal accidents due to the negligence of others to collect compensation on behalf of the deceased individual. However, an accidental death, while tragic, does not necessarily equate to compensation. There are many factors that the courts take into consideration.

In order for a death to be considered wrongful, certain legal conditions must be met. Obviously a human being must have been killed, but that death must have been the result of another person's negligence. This means that if your loved one was involved in a single-car accident, you will likely not be able to recover compensation for their death.

There are many circumstances which could lead to a wrongful deathh, including a car accident, medical malpractice, exposure to certain foreign substances and of course criminal activity. Car accidents are perhaps amongst the most common causes of wrongful death, but individuals who unexpectedly lose a loved one should always be aware of the possibility of a wrongful death lawsuit. For example, if your loved one worked around asbestos and died of lung cancer, long-term exposure may have been responsible for their death, and you could file a lawsuit.

If you live in Pennsylvania and you believe that your loved one was the victim of a wrongful death, consider meeting with an attorney who is familiar with Pennsylvania law. Consulting with an attorney can help you better understand how courts will approach the circumstances surrounding your claim, and could be just what you need for a successful claim.
