Pennsylvania man suing after tripping on uneven sidewalk

When people own a home, they are responsible for upkeep of that home -- particularly so that visitors or other people who might come to the home are not put at risk by dangerous conditions that exist at the property. This includes not only people who might go inside the home but people who might be passing by outside.

One man in Pennsylvania who recently took a seat in the state House of Representatives is suing the owners and residents of a home where he tripped and fell on allegedly uneven pavement on the sidewalk -- ironically, a residence that is in the district he now represents. The injury took place in March 2011 but the lawsuit was not filed until a week after the election this past November.

According to the suit, the man was out jogging and tripped on the sidewalk outside the home. He says he injured his elbow and dislocated his shoulder; because he did not have health insurance at the time of the accident, his medical bills were extensive. The man is seeking $50,000 in the suit, which names not only the couple who owned the property but also the two people who were living there at the time.

When people are injured as a result of negligence or dangerous conditions, they often explore their legal options by consulting with an attorney who has experience in premises liability cases. In this case, the homeowners might not even have been aware that they had a potential hazard on their property, but that does not absolve them of their responsibility to take care of it.
