Toyota may settle lawsuit in class action

The unintended acceleration problem of some Toyota vehicles may soon be settled in federal court. The exact value of the deal can only be estimated at this point in time, but it is believed to exceed $1 billion in settlement of the claims. This is separate from the $2 billion Toyota has already spent concerning recalls of the vehicles in question. There is also a question of $200 million in attorney fees to be reimbursed regarding court costs.

Attorneys for both sides are currently asking the federal judge presiding in this case to certify this products liability matter as a class action for purposes of settlement. Likely, the class will involve individuals injured across the country including residents of Pennsylvania.

For individuals injured because of the acceleration problems of the Toyota vehicles, it may be difficult to understand what is going on as far as this lawsuit is concerned. By being certified as a class, individuals may have to adhere to whatever decisions are made by the attorneys settling this particular matter unless these same accident victims are able to opt out of the class action lawsuit.

Since such a consideration can be extremely complex, accident victims would be well advised to gain the independent advice of a personal injury attorney that can help them understand the complex issues of this particular case. Though often accident victims are grouped together in class action lawsuits as a matter of convenience for the courts, this is not the same as saying that every individual that has been injured in an accident may be adequately represented in a class action lawsuit.

Personal injury suits deserve individual consideration as often these sorts of suits involve unique form of injuries and damages.
