Mother files wrongful death suit against driver that killed her son

Losing a loved one in a car accident can be tragic for the family members that are left behind especially if the driver chose to drink and drive. This week a mother of a New York man filed a wrongful death suit against the driver of the car that killed her son.

The car accident occurred on the morning of Aug. 25, when the driver lost control of the car and crashed into a retaining wall, a tree and a large metal phone-switching box. Upon impact, the car burst into flames, killing the woman's son instantly.

The accident was so horrific that her son had to be identified through dental records. The driver of the car, 22, was also seriously injured in the accident with compound fractures in both of his legs.

Officers reconstructed the scene and charged the driver with aggravated DUI in the car accident.

This was a tragic accident and nothing will bring their son back, but filing a lawsuit may help bring closure to the family.
