Family of man killed by inflatable slide settles lawsuit

A wrongful death lawsuit filed by the family of a man killed during the collapse of an inflatable slide outside of a Major League ballpark has now been settled. Apparently, the slide fell right on top of the man and took his life.

The 54-year old man apparently suffered for 8 days after the accident occurred. An investigation made by that state's agricultural department made a determination that the slide was not set up properly, and that failure to do so likely contributed to the slide collapsing. "This slide was set up in front of the ballpark - no anchoring at all, blown up, three stories high, 400 pounds, maybe 12 kids climbing up the slide at the time," said the attorney for the family.

The settlement payout was made by the manufacturer of the slide and the manufacturer's liability insurer. The case was settled just prior to the scheduled trial that was about to begin. However, the settlement amount has not been disclosed.

It's not unusual for trials to settle in this manner. Often, manufacturers are reluctant to settle these types of matters unless there appears to be a likelihood that a jury will rule against them at trial.

Negotiations between the attorneys of each party in these sorts of cases can be contentious, and the lawyer for the family will likely have to convince the manufacturer and the insurance company that a settlement will be less costly in the long run than going through the entire process of a trial.

Whatever the payout was concerning this matter, it will never make up for the loss of a family member. The purpose of the settlement, however, is to prevent the family's situation from becoming any worse due to this unfortunate accident.
