Courthouse News Reports on Hepatitis C case filed by Bill Caroselli and Lynne Johnson

The Courthouse News reported on our Hepatitis C medical negligence case filed on September 3 in the Court of Common Pleas of Allegheny County. Linda Ficken sued UPMC Presbyterian Shadyside, Maxim Staffing Solutions and Medical Solutions claiming that she got hepatitis C from David Kwiatkowski, the technician who was arrested for theft and fraud in New Hampshire in July.

Ficken was infected with Hepatitis C while undergoing a procedure at Hays Medical Center in Hays, Kansas, while Kwiatkowski worked there in 2010. Shortly after the procedure it was discovered that she contracted Hepatitis C.

The suit also names two staffing companies accused of placing him in many jobs despite his checkered past. Medical Solutions is accused of not doing a thorough background check before hiring and placing Kwiatkowski in numerous hospitals where he had access to Fentanyl and other narcotics.

The complaint lists seven other medical facilities in Maryland, Arizona and Pennsylvania, where Kwiatkowski worked after UPMC fired him. Patients at each hospital have been alerted of the possibility that they could have been in contact with Kwiatkowski and may have been exposed to Hepatitis C. UPMC Presbyterian sent letters out earlier this summer offering testing for patients who may have been exposed and set up a hotline for calls about Hepatitis C exposure.

Employees of UPMC Presbyterian who may have been exposed to Hepatitis C while working with David Kwiatkowski should also be tested for the virus. If you are or were employed at the same time as Kwiatkowski at any of the facilities you may be entitled to workers' compensation.
