Pennsylvania child suffers brain damage following surgery

A Pennsylvania child was awarded $1.1 million concerning a recent medical malpractice lawsuit. It was asserted that the child received a brain injury following sleep apnea surgery. The boy now purportedly suffers from developmental delays that may last a lifetime.

The operation occurred when the boy was only 11 months old. The doctor then performed surgery to remove the boy's tonsils and adenoids while inserting ear tubes. However, after the operation the boy apparently had breathing problems and was kept in the recovery room because his oxygen level was so low. A few hours later, after the boy was placed in a hospital bed, the boy had stopped breathing, had no pulse, had to be resuscitated and, as a result, suffered brain damage.

It appears that the jury was convinced that no injury would have occurred without malpractice having taken place. It was alleged at trial that the hospital failed to place the boy into intensive care, and that the boy's condition should have been monitored while he was being hospitalized.

There are likely a number of other similar type cases in Pennsylvania that never make it to trial. So-called reforms in Pennsylvania concerning medical malpractice lawsuits have been put in place in recent years, and this has likely led to fewer such medical malpractice claims making it to trial.

It must be emphasized that many such cases concern traumatic injuries such as the one suffered by the young boy. Attorneys that practice in the medical malpractice area know how to navigate such cases through the court system to make sure that the victims of such malpractice are heard.

No one should be forced to endure brain damage due to hospital staff not paying adequate attention to a patient's condition.
