Defective pool slides lead to severe injuries and deaths

A Pennsylvania woman fractured her neck while using an inflatable pool slide. The pool slide, which has been deemed a defective product, is now being recalled the Consumer Product Safety Commission (CPSC). It has been implicated in the death of another woman who also fractured her neck.

Apparently, there are a number of known problems with using the slide. The CPSC reported that the slide can deflate during use resulting in individuals striking their heads against the ground. The slide apparently is also unstable and can topple over while being used. Finally, the CPSC claims the slide contains inadequate warnings or instructions that would have prevented the accidents from occurring.

The pool slides had been sold at Wal-Mart and Toys R Us from January of 2005 until June of 2009. Each pool slide sold for approximately $250 each, but the slides were actually manufactured in China.

Though products are frequently recalled by government agencies such as the CPSC, such recalls generally do not occur until someone has alerted the agency that an accident has occurred. Such accidents usually result in severe injury or death, and often times the CPSC learns of the accident only after an attorney has filed a products liability lawsuit on behalf of injured victims.

Products liability is a specific area of personal injury law where manufacturers are held liable for designing or manufacturing a defective product that causes the injury to another individual. If there is no way of designing said dangers out of the product, the manufacturer at least should be doing everything necessary to warn about such dangers.

Having said that, no one should break their neck as the result of a defective pool slide that is being marketed and sold.
