Pennsylvania's highest court upholds $20.5 million verdict

It's not uncommon for a child to contract cerebral palsy due to birth injuries that occurred because of a doctor's mistake. It is often associated with oxygen deprivation that occurs during labor. Unfortunately cerebral palsy is generally a lifetime ailment that has no known cure and can result in severe debilitation.

Due to a child being afflicted with cerebral palsy which is alleged to have occurred during the childbirth process, a Pennsylvania jury returned a verdict of $20.5 million against the treating doctor and medical center, and the Pennsylvania Supreme Court has denied the doctor's petition for an appeal. This is one of the largest medical malpractice verdicts returned in the Pennsylvania area.

The reason why attorneys and their clients are able to return such large jury verdicts is because most such cases are anything but frivolous. The jury is putting itself in the injured child's shoes and understands the devastating injury that came about because of the asserted medical malpractice.

There are a few things to keep in mind in the face of such a verdict. The combined costs of medical expenses, medical care, wage loss, and required services for a lifetime of care of the brain injured child is easily in the millions of dollars. Negligence that results in a child contracting cerebral palsy has basically deprived that child from ever being able to care for himself or contribute to the care of another. The child will also endure a lifetime of suffering due to such negligence because of the cerebral palsy and probable brain damage.

Probably no amount of money could ever compensate a child for what he will have to endure because of the contracting of such a malady. The verdict may at least allow the family to care for the child in what otherwise would be an impossible situation.
