Why is it so hard to get insurance companies to do the right thing?

Like the sun rising in the east, you can count on insurance companies to work every angle and file every appeal to try and avoid paying legitimate claims.  You have to take them to court to get them to do anything, and for most people, that's not a practical option.  Frankly, it's what the insurance companies are counting on.

That's why Attorney David Senoff and Caroselli, Beachler, McTiernan & Conboy took on the case of five-year-old Kyler Van Nocker.

Kyler has neuroblastoma, a rare form of childhood cancer that attacks the nervous system.  He's been fighting it every day for more than two years.  Late last year, he needed a treatment called MIBG.  His health insurance company, HealthAmerica, told his parents, Paul and Maria, that it wouldn't pay for the treatment.

The problem is, HealthAmerica is using faulty reasoning and unreliable arguments to deny coverage.  Since the only way to get an insurance company to do the right thing is to take them to court, that's what we're doing.

Think Progress pointed out in a blog post today that "One of the worst abuses of private insurance companies is the practice of using spurious reasons to deny claims for medical treatments, which are often necessary for saving patients' lives."  We couldn't agree more.
