JOHN W. MCTIERNAN: In Pennsylvania, in order to pursue a claim for medical negligence, you have to file the claim within two years of the date of the negligence. If you fail to do so, your claim will be forever barred. Equally as important, you have to have what we refer to as a certificate of merit. That is we have to have an opinion from a physician in the same or like specialty that indicates that your claim does have merit, that the physician whom you may be seeking to file a claim against did in fact deviate from the accepted standard of care.
