FRED C. SOILIS: Individuals call us when they've been offered a lump sum settlement wanting to get our opinion as to whether or not the offer that has been extended is appropriate and is reasonable for their case.
DANIEL K. BRICMONT: Not every case is appropriate for settlement. The workers' compensation law provides both a wage-loss benefit and medical expense coverage. And we want to make sure that the client has actually reached the point where they're physically well enough to settle the case.
THOMAS G. SMITH: People have to be very, very careful because insurance companies want to settle your entire claim. In other words, you have to give up the right to collect your weekly checks, which are your disability checks, because you cannot work. But they also want you to give up your right to future medical.
RHETT P. CHERKIN: In our firm, we look at each case on a case-by-case basis because it is not always in the best interest to settle a worker's compensation case. Or if it is in the best interest of an individual, maybe it's only in the best interest to settle the wage loss opposed to both the wage loss and the medical.
THOMAS G. SMITH: An individual should never settle their workers' compensation case without first seeking advice from an attorney because there are a lot of issues that person may not be aware of that by calling and speaking to a competent workers' compensation attorney they will be able to get information that the insurance company's not going to let them in on.
