JOHN W. MCTIERNAN: In Pennsylvania, operators of motor vehicles are required to insure those vehicles. And part of that insurance involves an election. That is do you want full tort or limited tort? Full tort allows you to pursue a claim for damages if you've been injured in a motor vehicle accident as a result of someone else's negligence.
TIMOTHY CONBOY: But if you have unfortunately chosen on your automobile insurance policy coverage which is known as limited tort, you can be limited in your ability to bring a claim for your personal injuries. An individual who has limited tort insurance coverage is limited to bringing a claim only for their economic losses. Economic losses are losses such as lost earnings or medical expenses that are not otherwise paid by your automobile insurance. To bring a claim for pain, suffering, aggravation, inconvenience, and loss of life's pleasures, if you have limited tort coverage, you must have sustained a serious bodily injury.
JOHN W. MCTIERNAN: So when you're making that election, please make sure you act responsibly and elect the full tort option in order to preserve all of your rights under the law.
