DANIEL K. BRICMONT: The average weekly wage is one of the questions that's frequently asked by injured workers because it deals with how their benefit rate is calculated. The average weekly wage is a look backward in time one year prior to the date of injury and then is an averaging of the earnings that have been generated during that year. Now this is for most workers who have hourly wages. That is their pay is based on the number of hours they work times an hourly rate. And it's a crucial evaluation because that is what determines your benefit rate. One unfair aspect of the average weekly wage calculation and benefit law is that there is no cost-of-living adjustment. So one of the first items that you want to review when you've met a new client is that wage calculation to make sure that they're getting every dollar that the law says they're entitled to.
